Money Taken Off Credit Card "illegally"?

    Hey,

    I was just checking my CC bill today when I noticed a charge of 158.09 from a name that I knew I didnt owe any money to.

    I googled the name and it turns out its a well known Broadband Provider who
    were offering a free trial back about 6 months ago.
    I signed up for the trial then *before* the trial period was up I cancelled it and went with someone else. (NTL)
    Sent back modem and there was a bit of confusion in email about cancellation but eventually I got an email saying that all is ok.

    Last month I got a bill in the post saying I owed €73 euro, rang them up and they said oops thats an error forget about it.

    Then today when I ring them up Im told that apparently eircom must have changed my account number because they cant turn off my BB with the number I provided at the start.

    They kindly offered to refund me the €158 tomorrow if I give them my new eircom number.

    What I want to know is, is what they did illegal?
    Should I be ringing Visa and letting them know about this "fradulent" charge?
    What am I entitled to?

    No, it's just a mistake.

    Visa prefers you sort out mistakes rather than doing a chargeback.

    Not fraud. You would have given authorisation to the BB provider to charge your card. They have just done in erroniously or as a result of a c**k up that it is not unusual with telecoms companies.

    Well technically once a contract commences then they are authorised to debit my card.
    No contract started and I cancelled the trial about 5 months ago...
    They are trying to blame eircom for changing something but nothing has changed.
    A different bloke on the phone was able to refund my account, dunno why the first TWO couldnt.

    In most cases the contract starts when you agree to the free trial. What they are agreeing to is that you get x months free and the right to cancel the free trial at a certain point. I don't envy you they will probably takes months to rectify their error.
