Guitar problem

    i got a guitar about 3 weeks ago now
    its a jackson dxmg
    anyways
    since day one its sounded like pants
    theres something not right thats for sure,
    i brought it back about a week ago
    they supposedly "fixed" it
    but it still sounds like **** only really when clean
    its rattly and is impossible to tune, its never in tune
    it bends without me even bending the strings - changes pitch too easily
    basically anything clean on it sounds horrible
    any ideas on whats wrong or what i should do what be great

    Take it slowly....

    what is wrong with the sound? Where is the rattling coming from? Does it go out of pitch only when you use the tremolo or does it just go out of tune when you play?

    The strings rattle a bit much for my liking,
    and it just never seems in tune...
    playing a simple riff for example the one i notice it most on is the intro riff to A tout le monde (Megadeth) just playing that sounds horrible
    the strings seem to be at different tunings at different frets...

    Sounds like your intonation could be ****, but it seems a little drastic for a new guitar.

    Have a look at this guitar setup guide, right click and save the link. Just go through what it says but don't make any adjustments. Check the bow in the neck of the guitar. If you have an electronic tuner go through the intonation check (play an open string, then play the 12th fret, the note should be exactly the same). If you don't have an electronic tuner, get one as soon as you can. If the setup is off, bring it back and tell them what is wrong.

    Stretch the strings, pull them away from the neck at the 12th fret. The guitar should go dramatically out of tune. Return to pitch and do it again, do it a few times. Then tune up and see if it makes a difference.

    I find with my guitar up at the 9th frett and above the strings are raised alot more than the lower half...any idea on how to fix that?

    Yep, the neck is bowed forward and probably needs a truss rod adjustment. Read the setup guide. However, if you haven't adjusted a truss rod before bring it to a professional to adjust for you. If you break the truss rod your neck is buggered.
