Signed contract,want to quit before starting.

    Heres the deal, a friend of mine signed a job contract for a job which is due to start at the end of september. In the mean time he found a better job and has been made an offer by them.

    Does anyone know the legal stand point here? ie. is the person tied to the contract, even though they have not started.

    Can he take the second job and not bother taking the first job? Will there be trouble?

    I don't see why not.
    Just make sure he signs the second contract and explains the situation to his new employers, before pulling the rug under his current (but not started) employers!

    has he given any tax certs or anything to emp no 1? if not then no you dont need to say anything to no 2.

    The law is there to protect the employee. They will be pissed off, but there is nothing they can really do. This actually happens all the time - just make sure you are happy with the choice you make.

    I'm sure they'd prefer he told them now, instead of if he starts and they pay for equipment/training/whatever. He should ring them and discuss it. He should be sure that's what he wants, if he rings them now and tells them he's quitting before he even starts they're not likely to take him back a 2nd time if he changes his mind.

    Thanks for all your input, he hasnt sent any tax certs in as far as i know. Hes gonna let employer number one know before he is due to start, he wont just not turn up. Thanks again.

    There's usually a 30 day termination clause on the contract.

    Yup, obviously it depends on the contract, but from their side it is usually initially one weeks notice. Iif you hand in your notice on or before your first day what sadistic company would bother asking you to come in for the 30 days?

    On the plus side my GF was in exactly the same position, she had been working 1 day in a certain place and got offered a great job elsewhere. Handing in her notice her company served suggested they serve notice on her and she could leave immediately. She was paid in full for the one weeks notice without doing a tap of work!!!!!
