Injured at work

    A few weeks ago I tripped over a loose carpet tile at work and hurt my knee, nothing too serious just a strained ligament. I was off work for a few days, which my employer paid me for.

    I went back to work, but a few days later the knee was still sore. I felt a twinge while walking at home and all of a sudden it just went from under me. This time it's a little more serious and the doctor wants me resting for a month.

    My employer is now refusing to pay me any salary, saying the injury did not happen on their premises.

    Does anyone know if I am entitled to be paid? I can't afford a month with no salary :( Is it worth my while consulting a solicitor?

    It wouldn't harm to talk to a solicitor, although this would up the ante and you could possibally kiss any promotion prospects goodbye. Try to agree something where you can take the time and they don't get sued.

    **Take photo of carpet and complain about it.**

    You would certainly be entitled to disabilty (and some other limited benefits) if you need to.

    Acid mate this is happen to me and currently is on going in my work place and I sustained a serious back injury, now pay was not denied but I got a horrible 1% raise at xmas and my time is limited at the moment in my current employer, tbh it is now a disgusting enviroment to work in and my promotion etc are gone so alas I will be leaving when a better job comes up.

    Firstly challenge them and threaten legal acid and say you have taken photos of the area were it happened even if you did'nt, it's called bluff.

    And also to a solicitor to cover you arse, why? So they cant fire you and also now put them in a precarious postion, making you safer for the short term.

    F*ck people like them they are scum and drive me mad.

    A lot of employers in this country think they are above the law!

    F*ck them!

    Legal action is a last resort, I'll talk to them again next week and try to make them see sense. I will take action if necessary, however.
    I'm not looking for compensation, or anything, just my normal salary which I feel I am entitled to.

    I got a friend at work to take photos of the place where it happened. I also have several witnesses who saw me trip, and there is a cctv camera looking right at that spot also.

    As for promotion etc I don't really care, I'm leaving in about 6 weeks anyway to go travelling.

    Dont say anything further until you have a chat with a solicitor, as they will advise
    what to say and more importantly what not to say.. as you may say
    something in the heat of the moment that could seriously affect the outcome of any
    further action if required.. you dont have to mention this when you talk to them next
    but at least you will have consulted with one and know where you stand legally.. it
    may open your eyes aswell to some things you may not have even thought of..

    For the sake of a few quid, its definitely worth it as if this turns out to be a serious
    injury then you should seek compensation if even just to cover the cost of medical
    expenses.. however going in there to talk to them without having talked to a solicitor
    first could leave you seriously out of pocket in the future..

    Dont take the attitude "I'm leaving in 6 weeks fo feck it".. as it could take a lot longer
    than that to sort this out...

    If a doc advised you to rest for a month, then that is just a measure of how
    prolonged use of your knee without the appropriate rest could lead to long term
    damage and a lot of suffering in the future... so it could be more serious that you
    think or feel at the moment..

    Go to a solicitor mate.. it will probably cost a €100 but it better than having to fork
    out a few thousand euro for medical treatments if it turns out to be worse than you
    originally thought..

    Don't be surprised Acid if the tape goes missing or it "wasn't recording" at the time of the accident. Is it possible for you to get a copy before you have to mention it? It's obvious from the tone of your post that this is a genuine accident. I don't condone people looking for compo for the sake of the money but in fairness, you seem like you're genuine.
