What the hell is a nightclub? (technically speaking)

    A lot of threads on here have been about access to pubs and clubs and the consensus I've seen is that one must be allowed into a pub unless underage or intoxicated or barred for previously caausing trouble there. Whereas people seem to think a nightclub can refuse anyone it wants for any reason it wants. Well the only problem I have with this interpretation of the law is that to the best of my knowledge nightclubs, as we know and love them, are not defined in law! They are simply public houses which happen to have a dance licence and a late bar licence. Thus how can they have a different right to refuse entry/service?

    i agree totally.i have been turned away from nightclubs with the excuses of "over 24's tonight" "not tonight lads" "we dont accept garda ids" "we dont accept passport ids" its stupid! i think legal action is the only way to teach nightclub owners a lesson.what makes some bouncers think they are boss.some (not all) are nothing more that a big guy with a small brain

    There is a big difference between a club and a late bar. A late bar is a public house with a late license. A club is... well... a club. Which is not public. And they aren't subject to the same rules as public houses.

    There's no difference between the two in legal terms, a nightclub is simply a Licensed premises that has a Public Dance Licence. There are, however, different laws applicable to 'Clubs' as in Golf Clubs etc, in terms of the Licensing laws, but there's no difference between a Late Bar and a nightclub, except that a Late Bar probably won't screw you for an admission fee. Any laws relating to admission to, or refusal from, a Pub, or Late Bar, are the exact same as those that apply to Nightclubs.... And on a side note, you are NOT entitled to a reason for refusal at the door, at least not at the time of refusal. Dublin publicans are specifically advised by the Licensed Vintners Federation NOT to give a reason for refusal at the door. If you feel you have been discriminated against and decide to take them to court, they must then, but only then give a valid reason for refusal. In reality, most of the time if you look for a reason at the door you will get one, but it'll probably just be diplomatic bull.

    its a place where people with bad tastes in music congregate to drink, dance(badly), pop a few E's, leave, fight outside with some *muppeh* and steal all the traffic cones on their way home...
