Construction Noise

    I got woken up this morning at 7 by the sound of a kango hammer. Right now, I'm not too happy. I have it in the back of my head that construction/council workers cannot start using heavy machinery until 8 am. Can anyone back me up on this? Because if that bas***d starts tomorrow at the same time, I'd like to call the gardaí on his ass

    Section 108 of the Environmental Protection Agency Act 1992 would seem to agree with you. However, it only entitles you to make a legal complaint. Noise and nuisance are civil matters IIRC, and so while the Gardai may come down and inform the workers that you're unhappy about the noise, they can't do anything about it unless you secure a legal order preventing them from doing it. Of course, they may be able to insist that the noise stops, in the interests of maintaining the peace, such as they do with house parties etc etc. But that would involve having to call them out every single time the noise started. The Gardai cannot insist they stop the noise permanently without a court order.

    Although, that's worse case. Go down, find the foreman, and have a chat with him. If they're local authority workers, they're not going to be particularly annoyed about sitting around on their arses till say 8am before they can start.
