False Advertisement?

Hi guys, iv bought a ford focus from a main ford dealer that was advertised with heated seats, i test drove the car and after much haggling we agreed on a price, A big part of the cars selling point was its extras which the sales guy kept pushing including the heated seats but when i picked it up from garage and asked him to show me where the button was for the heated seats he said they were not in it. i told him i wasn't happy and that it was a big problem that it was advertised but not in car, he said he will contact me on Monday after he checks the spec with ford he seemed as surprised as me. Should i return the car and ask for my money back or can heated seats be installed in the car or is there any other options?

Had a salesman once who got confused with heated seats and electric seats , perhaps your guy made the same mistake but if he sold it with heated seats and they are not in it, you have a case , is it on any advertising document

1. Return it and ask for full refund.
2. Return it and ask for the model and spec you ordered.
3. Get a discount and keep car.

I'd go with #2, or it is possible to retrofit heated seats and its not a big job for a Ford garage to do, it would just require new seats being ordered, wiring for the buttons is probably all still there.

unless its a new ish.. titanium spec.?

No it doesnt have electric seats, i printed off the carzone ad and the one on therr own website and they both say heated seats

Thanks senna, i like the car so number 2 or 3 sound good to me, i just hope the dealers see it that way and dont drag the ass out of it

Ads meant nowt - in contract law they are an "invitation to treat" as opposed to an "offer to sell" iirc. Mistakes can and do happen.

Why didn't you check the car over fully before buying it?

yep its a new model 11 reg, there are a couple on web that have heated seats, well according to ads they have

To be honest i never had a car with heated seats before so when i test drove it i just presumed they were in it, It was only when i was on forecourt and asked how they worked the problem occurred. I kind of thought by going to a main ford dealer things would be as advertised

I doubt very much they will fit heated seats for you unless you are willing to pay for them. If you don't want to hand back the car then I don't see what other options you have now that you have already bought the car. The best I think you can do is push for a free service because of the mix up.

Am I correct in understanding that you noticed or were told at the vehicle handover that there were no heated seats, but you took delivery of the car anyway?

as i was sitting into car at the forecourt the salesman said he would go thru the workings of the car, when i asked him about the seats he spent about five mins lokking for the heated seat button and then said he didnt think it had heated seats. I had already paid for it by that stage

Nonsense. Check the http://www.irishstatutebook.ie/1980/...016/index.html which states that goods must be "as described" in advertising materials (well done OP for saving web ads) or in conversation with the salesman.

Please, please check consumer law before dismissing or commenting on it.
