seller wants come back after two weeks

hi i swaped my android tablet http://www.adverts.ie/other-computer...tablet/1186560
for a nokia x6 http://www.adverts.ie/mobile-phones/...6-16gb/1307992
and seller now contacts me saying item is now over heating but he has already said in last comment on x6 thread "The tablet is as he said and I'm happy with his response"
witch ment problem wasent there when i sold it to him so should i refund him his phone even though i know the tab was working grand or is it his loss please help

There's no comeback after two weeks of use .

If the item was as described and accepted by the other party as such then that's the deal done . If a fault came to light within a day or so there may be a 'moral' obligation but not after two weeks .

That seems rather odd advice. How do you establish the condition of an item without using it? What happens if, after a relatively small number of uses, an item stops working or develops a problem. Isn't it reasonable to say that if an item gives trouble under those circumstances then it couldn't have been as described initially, eventhough it may have appeared to be.

Is your response covered in the rules or is it a personal opinion?

Since this was only bought a couple of weeks before you sold it maybe it is still under warranty and you can pass this on to the buyer ???

It's covered - or rather not covered - in law . Link

Aside from the fact that this was a swap unless the seller offers an item as part of their business the buyer is not considered a consumer so there's no legal obligation to refund .

Nessy's advice there was pretty good. If somebody buys something, checks it and all is working then an issue that only comes to light after a number of weeks then it really is a mattter between buyer and seller.
