These sort of laws if past, would have greater implications if passed then just to the open source software?

there are disclaimers before any software is installed
that is eneough of a safeguard

I agree, and more so with open source, as no payment is given, no contract is implied.

yes no contract is implied but there is a disclaimer and it wont be installed without you asking and going through the installation

no harm done - except by lack of responsibily and know how by the end user
