Hi all,
Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

    May have the wrong section but i said id post in here .
    A friend mine is working in a job somewhere in limerick i dont want to the say the name of the place but she is 18 and is only getting 8 euro an hour is that illegal also they taxed every penny of her wages one week off 180 euro and havent paid it to her are they doing something dodgey??

    Also they said they dont have to give her minimum wage because she isnt 21 ??:eek: wtf

    The National Minimum Wage Act 2000 provides that the minimum wage rate for an experienced adult employee from 1 July 2007 is €8.65 an hour, (was €8.30). An experienced adult employee for the purposes of the National Minimum Wage Act is an employee who has an employment of any kind in any 2 years over the age of 18. (See also "Rates" section below).

    The National Minimum Wage Act provides the following sub-minimum rates:

    * An employee who is under 18 is entitled to €6.06 per hour (this is 70% of the minimum wage)
    * An employee who is in the first year of employment since the age of 18 is entitled to €6.92 per hour (80% of minimum wage)
    * An employee who is in the second year of employment since the date of first employment over the age of 18 is entitled to €7.79 per hour (90% of the minimum wage)

    This phasing in of the National Minimum Wage also applies to employees who are over 18 and enter employment for the first time.

    as far as i know in order to get minimum wage you have to be working for 2 years, not many places really enforce this.. also she prob got taxed so much cause she didn't give them her p45 or summit like that so she's prob on very hefty emergency tax...but the whole wages? not sure about that, that seems odd but im not sure how that works so wouldn't know

    if she has worked for 2 years in other places as far as i know she is entitled to minimum wage but if she hasn't, she isn't
    also not sure what the cut off age is you said they said 21, could easily be that

    Hey,
    1. Yes, she does not have to be paid minimum wage unless she has at least two years work experience. If she has two years work experience - then she has a right to minimum wage. I think for under one year experience employers can pay 6.92 (or such), under two its roughly 7.79. (80% and 90% of minimum wage).

    2. She is on Emergency Tax, she has to claim back her tax and the government will pay it all back, but yes... they take something like 40% until she claims it back, she wont be taxed after that!

    If she is terribly unhappy there with the wages and if they will not change the conditions then she should leave.

    As soon as the Revenue Commissioners are advised that you are working (ie,your PPS number is submitted) the employer will refund the tax which Revenue took. If they don't, get your friend to go down to the offices just past the Granary (River House? Georges Quay??), they're very good in there, usually get everything sorted with a few keystrokes. Until the PPSN is submitted (and employers can be very slow doing this), your friend will be taxed as follows:

    Week 1-4: If paid less than 680.76 - tax is 20%. If paid over 680.76 - tax is 41%.
    There are minimum tax credits assigned.

    Week 5-8: As above but with no tax credit.

    Week 9 onwards: ALL pay taxed at 41% - no tax credits.

    hey guys only got a chance to come on check but she has been working since she was 15 and is 19 in two months so thats well over two years ? so surely now they should be paying her minimum wage ? Is that right ? The person in charge of wages claim she isnt entitled to it and will only give her 8euro? also the person said she was lucky to be even getting the 8euro something has to be serioulsy wrong here anybody got any suggestions?

    As said earlier, it seems that you only get 'experienced' after you do work as an adult.
