Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

NAMA/Receiver increasing rent and taking car space

    Hi, back in February NAMA/Receiver informed us rents were going up 150 per month. Now just last week they said they are reducing our car spaces from 2 to 1. It feels like we are been bullied!

    We have the lease extension agreement from last month and were just about to send back a signed copy until they rang last week with this latest news. I have lived here for nearly 6 years and it's really frustrating to see them throw their weight around like this.

    Does anyone have advice on how to handle this? PRTB any use in these situations?

    That was the whole point of the PRTB but if you're starting a new lease then I guess they can impose new conditions. If it's not a 'new' lease but rather an extension of the existing agreement the I would imagine you might have a case through the PRTB or even via a solicitor.

    Sounds like a really nasty thing to do though, maybe send Mr E. Kenny a harshly worded letter ?

    When was your last rent review and how many parking spaces are listed in the lease?

    Last review was in February 2014 to which they increased the rent by €150 from March 2014 onwards. There are two spaces listed in the last lease agreement signed in 2012 and in March we received a letter stated "lease agreement extension" to which we were returning as signed this month until they phone last week to say they are now taking away a car space.

    But you've got an active lease in place that specifies two parking spaces, yes?

    Renting there since October 2008.

    There are two car parking spaces specified in the last signed lease which I would imagine is still in place until a new one is signed?

    Did you always sign a new lease every year? When was the last lease signed?

    Did they propose a new lease which only has one parking space? What compensation did they propose? Did you even ask?

    Last lease was signed in February 2012. New lease extension agreement did not refer to reduction of car spaces. This was only verbally communicated last week over the phone.
    They have proposed to reduce rent by €25 per month. But that constitutes a second rent review inside 12 months right?

    That second car space is worth a more than €25 a month, depending on where you are located and if you're using it at present.

    When did the reciever take over?

    They don't appear to be covered by the tenancy act

    They took over in 2011. How would they not be covered?
