Hi all,
Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

What is a caution statement?

    Someone close to me was recently involved (and badly injured) in a road traffic accident where a commercial vehicle was responsible for knocking her off her bicycle.This was reported to AGS...report was taken at the hospital and followed up by a call out to take a statement.

    She was told that the circumstances required a 'caution statement' because she had alerted the encroaching vehicle by banging on the side panel.

    What is a caution statement? and, why in this instance?

    A cautioned statement is a statement where a person is given the legal caution of "you are not obliged to say anything unless you wish to do so..."

    It is done in cases where there may be a possibility that a person may have committed an offence. For it to be admissible in court the caution needs to be given.

    The most common examples are traffic collisions and assaults.

    As foreign says it is in case there is a wrong doing on either side in a case. Most common examples are car crashes and the like, it is usually a case of he said, she said with often very conflicting reports. As such caution statements are taken in case anything is said in that statement which may be used as evidence in a prosecution of either side. Providing a caution statement doesnt mean that you are a suspect or are being accused of having done anything wrong but covers everyone if anything incriminating is said

    No even if you are not at fault it is read to both or any number of parties envolved.

    It is a shock when you hear for the 1st time as you would here it read to criminals but nothing to worry about as it just has to be said.

    Hope she is ok op and makes a full recovery never nice to hear or be involved or have someone close hurt.
