Pub licence - Can it be used for adjoining Off-licence

    Ok, so publican has the typical licence which allow the sale of beers, wines & spirits, on & off licence. Can he then open an off licence in his adjoining shop using the one licence or what is the requirement here or can anyone point me to any document relating to this situation.
    I have been told that many pubs with dedicated off licences next door are trading with the one licence & that all that is required is an application to the courts to extend the original licence to the additional premises. Is this roughly correct or total crap?

    How does that help anyone? I'd be interested to know this too. With the new laws which prevent selling after 10 surely the off licence would have to be seperated from the main pub. In which case would it not need it's own off-licence?

    Actually Im on the other side of the fence, doing some architectural work on a business premises & this cropped up. Publican wants to use his licence in this way but his solicitor appears to be coming up with alot of roadblocks. Just trying to get some background on this.

    Licensing law is becoming a specialised area.

    A pub licence can be extended into an adjoining area in the same ownership, but these are complicated and expensive matters, requiring detailed plans, compliance with Fire Officer Requirements, notices to and negotiations with Gardai etc. Then public notice and an application to the Circuit Court.

    YOu need a solicitor and barrister who do licensing work in your area. Judges differ in the scale of their requirements.,

    A separate off licence might be possible in the adjoining shop without extending the adjoining pub licence - involves afaik a District court application.

    Do you mean might be possible without extending the pub area while still using the one licence?

    Mickdw - Two separate options -either extend the pub area into adjoining premises, involving some building work, and a circuit court application, or a separate application for an offlicence in the shop.
