Hi Guys,

Anyone have any information on the United Nations Convention on the Rights of the Child? I know that Ireland have signed it and ratified it but does anyone know of its effect in Irish law i.e. does it bestow rights on individuals that they can enforce before a national court? I don't believe that it does have direct effect unless it is implemented but I would be interested in hearing the views of others on the topic. Thanks.

My knowledge of this is quite weak, I am aware of some form of retification and signature, I am not sure of the force.

Two conventions which are functional for Child Care and protection are the Luxembourg and Hague Conventions, most are in the entire area of Child Abduction.

UN conventions are not binding on Irish law, but they are fairly persuasive when interpreting legislation.

Other than that, the 29th amendment to the constitution bill seeks to enumerate the rights of the child in the constitution. I would be very sceptical about this amendment.
